According to US reports, the little boy was attempting to retrieve a toy when the incident took place. A supervising adult, thought to be his aunt Rena Oden, and a maid tried unsuccessfully to rescue him.

Thankfully, two male employees were working inside the house and were able to free the child, who was then given CPR and rushed to hospital.

Usher Raymond V is the singer's eldest child with his ex-wife Tameka Foster — their youngest son Naviyd Ely is four.

Only last July, the family suffered a terrible tragedy when Tameka's 11-year-old son Kile Glover died after being struck by a jet ski. "Tameka got a call from one of Usher's staff members and rushed to the hospital," a source told People.

Tameka, who divorced the singer in November 2009 after two years of marriage, reportedly filed legal documents on Tuesday asking for an emergency hearing on the grounds that Usher, 34, is allegedly creating a "dangerous environment" for the children.

"She almost collapsed when she heard the news. "She's still not over Kile, and now this happens. She is not going to leave his side now… We're all lifting him up in prayer. "It has since emerged that Tameka has filed for custody of Usher Jr and Naviyd following Monday's accident.

According to TMZ, the paperwork was filed in Fulton County, Georgia, with a request that the hearing takes place later this week.

Usher currently has primary custody of the two boys, a decision Tameka is seeking to reverse.

Tameka is reportedly claiming that Usher is "abdicating his parental responsibilities" by letting other people care for their children, the website reports.
