In what is shaping up to be a nasty divorce, Tom Cruise’s lawyer has fired back at claims Nicole Kidman made in court papers she filed late last week. Though Nicole asserts she was caught completely off guard when Tom asked for a divorce, his lawyer says otherwise.
“Tom has been a gentleman throughout these proceedings,” says attorney Dennis Wasser. “Nicole has always known exactly why the parties are divorcing. His children are his life and he will always provide for them and their security. Tom will provide Nicole with half of the community property consisting of tens of millions of dollars. Tom said to me, ‘She is the mother of our children. I will always wish her well.’”
Nicole tells a decidedly different story. “This came as a shock to Nicole ,” read the court papers submitted by her lawyer. “On December 24, the parties had happily celebrated their 10th anniversary with a group of friends. During the balance of December and thereafter the parties were intimate; in fact, Nicole became pregnant by Tom but lost the baby through a miscarriage.”
“Nicole protested Tom’s intention to dissolve their marriage and urged him not to leave but to enter marriage counseling with her or take other steps to address whatever problems may have existed in their marriage,” the papers continue. “However, Tom said his decision was final and he departed the parties’ home.”
In his February 7 divorce petition Tom claims the couple decided to split in December, before their 10th anniversary. Kidman says the separation occurred in early February, one month after the ten year mark. The quibbling over the date is in fact very important as California law dictates that if a man and wife separate after ten years of marriage, a spouse must pay alimony until the other partner remarries.
In other Cruise news, Tom is said to be dropping the $100 million lawsuit he filed against gay porn actor Kyle Bradford who allegedly told French magazine Actustar he and the Mission Impossible star were intimate and that caused the break-up of Tom’s marriage.
